Has anyone asked this member if he has permission to reproduce these graphics? OK, I'm not really that naive but I do enjoy a game of Devils Advocate! ;-)

    Probably not Justin,

However, I know about copyright and licenses, there is no way he has permission, it is just not possible.

Personally I wouldn't have given two hoots about it, if the quality of the website is anything to go by then the Merch is not going to be that good, however he insulted Gooner, who is, as you know, a great contributor to this forum and deserves respect from these low life's

And I thought I said rant over two posts ago ;-)

Not that I care much about the profits of multinationals, but it doesn't stop there, the same people who have no problem stealing images for profit, will not care if they steal from us little guys either:

A few examples from their Amazon account:
    http://www.amazon.co.uk/Dont-Bacon-H.../dp/B00S2P4TGG

Take your pick from who ever though of this idea first:
    http://www.amazon.co.uk/s/ref=nb_sb_...n+My+Heart+mug

    or this one I like:

    originally found here:

    not a mug seller though:

Anyway, is someone going to help these guys with their colours?

Hi there, another new guy question incoming.... I am slightly confused and this seems a perfect time to ask. The whole copyright thing seems a minefield to me. It is clear that producing something with a registered trademark would be a breech of copyright. (example : a Mrs Brown's Boy phone cover). However where do we stand in using designs which are dotted around the internet in different forms (a good example would be the bacon and egg mugs mentioned earlier). Who actually owns the copyright for these things?

I sell predominately bespoke military designs to the military however we are in the process of launching a website and would like to bolster our range with a few novelty mugs. Now the last thing I want to do is steal any ones ideas but there are so many similar designs out there that I worry it is a minefield and there are a lot of copyright nazis out there (rightly so in most instances but occasionally a little over zealous in their reactions).

As always advice and help much appreciated.

    Dave

Come up with your own designs, artwork and ideas, and you won't have to even be asking the question.
If you aren't talented in art or design, then hire someone who is to work for you.

The DSF is a great place for advice and I have had some real help from alot of folk here already but I am sad to say there seems to be an elitist core who clock up the posts by giving less than useful advice and sitting in an ivory tower above us new guys. I made the point in my question that I wasn't interested in ripping off peoples designs. Funnily enough, that is why I asked the question. What I did ask for was some advice on what dictates what design is copyrighted (other than trademark).

Pisquee, I have read this forum for a while and you have some great advice to give but rubbish replies like the one above doesn't help me as it doesn't answer my question. Seems you just posted to clock another number up.

To check if something is trade marked go here http://www.ipo.gov.uk/types/tmtext.htm

For copyright you have to assume everything on the net is copyrighted, to check if it isn't you have know who the original artist/designer is and they have to have been dead for 70 years before the copyright expires at which point it enters public domain.
You can not copyright a idea in the uk so if you draw a picture of a character from a book. flim etc as long as it is original then you should be fine. For example google alice in wonderland and look at the number of different alices each have there own copyright but have come from the same idea.
I think claiming that the becon & egg mug is breach of copyright could be hard if the becon and egg images and font are different from the original design. The bit I would be unsure of with that mug would be the wording I don't know where you would stand on that.
Also there was a parody law introduced recently in the uk which I think lets you use copyrighted stuff if you can prove to a judge that changes you've made make it humorous but don't go on my word with that seek legal advice first. If anyone wants to correct me on any of this I'm always keen to learn.
