    No because designer 1 had no knowledge of what designer 2 was doing. He wasn't copying designer 2, he was working to a brief which you supplied. Who owns the copyright depends on what contract was agreed. It's a hypothetical argument without seeing the two designs!

    In copyright you need to be able to demonstrate that the infringer had seen your original creation in order to copy it.

    I realise this post has gotten much more light hearted but I will tell you what happened to me
    I started embroidery a few years back and wanted a particular dog outline, at the time I could not digitise and my friend did one for me.
    Well I turned that into a Christmas tree decoration (cheap naff made out of felt £3 worth) I advertised it on the particular
    breed facebook page ( you can see where this is going can't you? )
    Lady says 'oh that looks like a drawing I did a couple of years back' and posts pic of said drawing there was absolutely no denying it was her drawing

    I messaged her and apologised profusely, asked friend where she had the shape from and she said google, I did not tell the lady a friend had done it for me as I could see no point in someone else being involved. She said she was happy for me to use it for myself but not to sell it. I explained to her I actually had already sold it

    I told her who too, how much, and how much profit I had made from it I also gave her the customers details so she could check everything I said was kosher
    I asked could i buy the design from her which she said she would think about.

    It gave me such a scare as a newbie I am very careful now, I designed my own outline (that was much better than hers ) and have made a lot of money from it and (fingers crossed) I never heard from her again
