I am wondering if someone could advise me as to what action I may be able to take.
This link will show you a wallpaper by B & Q. It shows a logo for a company called Redrington. This is an exact match for my father in laws fathers company logo. The company no longer exists but in the early days of F1 and grand prix the name Derrington was very well known.This is my wife and children in front of the garage doors at Brooklands Museum showing the correct logo.

Was the Derrington logo a registered trademark? there is not notification on the photo you've posted that that is even what the company classed as its trademark - the TM symbol.
You would need an IP/copyright lawyer to look into it for you. I would say the B&Q image shows a similar logo, which is certainly inspired by the Derrington logo, maybe even a parody of it, but it is not an exact copy.
By what definition does the Derrington company no longer exist - what happened to its assets (including IP when it was sold/dissolved) If no one can claim ownership of the logo, then I'm not sure what could even be done?

This is a better image of his logo. I am not sure if it was trademarked. There are other things that the family are trying to resolve as well. If you search for a Derrington and motor parts quite a lot comes up.

It is one for a specialist copyright solicitor. Part of the claim process is demonstrating that you have suffered a financial loss as a result of the infringement, but the logo is not currently in use as such. These can be difficult to prove and fight and will cost £1000s up front. If you won, they would withdraw the product from sale, but I can't imagine the reward being great. Principles cost lots of money.

In a case like this it would be more likely that B&Q if they think may lose the case may decide to settle out of court and offer a payment for licence as part of settlement so they dont have to withdraw. Certainly worth pursuing. I have passed on details of an expert in this field who will offer some advice on how to proceed. But yeah...instigating action will usually involve a large retainer.

Thanks for the help guys . My father in law is just Meh whatever but it has upset my wife quite a bit so we will be looking into it further.

Try this link http://www.ipo.gov.uk/tmtext/ it's the UK's Gov trade mark search very handy! I did a quick search for your Father in laws logo & it doesn't seem appear! but I only checked for the words as you can also upload a image.
