In your case, drawing a picture of Mrs Brown (instead of using the photograph) and calling it a Mrs Brown case is still a trademark infringement, because you implying that there is an association between your product and a trademark. Mrs Brown isn't an idea, an idea is in your head. Don't go bacon my heart isn't an idea either, it's a physical product with an automatic copyright.

But in a nutshell and to stay out of trouble, it's what pisquee said. The only grey area or 'debate' is for a judge to decide and you don't want to be in that situation. A judge couldn't give a f*** if you are a newbie or not...no offence.

If you have been following the news, copyright and publicity rights are getting very aggressive. Beyonce and Taylor somebody shutting down Etsy sellers for even mentioning anything associated with their brand.

Topshop lost and they owned the rights to the photograph!

I also have a friend who set up his own gardening business called "Mr Bloom" the BBC sent him a very heavy handed warning delivered Tracked and Signed for as apparently they have the rights to a TV gardening character called "Mr Bloom". Hence it can be a mine field.

Fan art (eg sketch Mrs Brown etc) is acceptable for your own use and pleasure....the moment you have an intention to make money from it, you are stuffed.

I am of course not a lawyer so do you're own homework, don't take my word for it.

Hi Guys

Total newbie here so can anyone tell me the following:

Firstly what kit do I buy as I can not be bothered to do a search on the forum (happens weekly)
Then tell me what I am doing wrong when I ignored the advice and purchased from ebay (happens daily :-))
Then listen to my rant because I can not make £15.00 profit per mug/phone case/slate/anything else (why do people think this is a get rich quick scheme)
Accept my lies when I say I have copyright permission (this has happened when I actually knew the REAL copyright owners)
Tell me what is okay with regards to plagiarism and what isn't, as a DSF forum means you HAVE to answer questions about this subject (happening on this thread)


If I do not get answers to the above I am going to throw my toys out of the pram and complain that PREMIUM members are being rude to us FREEBIE NEWBIES. It just not fair that I have been on this forum less than 3 minutes and am not getting my own way. And I am now off to complain about super moderators who have given nothing but sound advice for years but apparently has it in for me. It obviously has nothing to do with the fact that I read threads incorrectly and has everything to do with everyone BUT me.

Am now off to message other newbies in some sort of lame attempt to validate my comments.

Most newbie's are brilliant and it is all about how you approach a subject. There have been a couple recently that have lied (its for personal use honest guv) or get the hump when they do not hear the answer that they want to hear. All I can say is grow up and sort your own business out, do not leave it to us, we are to busy trying to print items before you copy them...

I didn't want to say anything more because socialgiraffe finished it off nicely with his post of the year. But in your examples, implying that you are associated with official merchandise or a brand is why they fell foul of the law. So Heisenberg, chemical symbol T shirts or "inspired by Game of Thrones" quotes on craft products, hash tags underneath your product even if you created all these designs yourself will get you in hot water.

legally, an implied connection is called "passing off" i.e. you're trying to pass off your work as being official in some way... and this is where Top Shop fell foul of Rhianna, as they printed up a Rihanna photo onto a tshirt. They owned the photo and had right to use it. The problem was, that they used to have an official cross promotional relationship with Rhianna, which they don't have anymore, but due to this, it was seen by Rhianna (and the courts) that Top Shop were trying to pass it off as official merchandise.

Just curious.....

1. Say I was at a Gig where you "could" take pictures. Could I then print that on to a tee and flog them.

2. Say I was walking down the highstreet and I snap someone. Could I then print that on to a tee and flog them.
